Terms Of Service

1.) Service Setup:

We have strict anti fraud measures for new signups and so we perform manual antifraud checks as per our procedure after we have received your payment. Once these checks are completed, your service is activated and you will be sent your service information email. It is your responsibility to provide us with a valid email address which is frequently accessible to you as your primary contact point for all communications with us. We will be using this primary email address to contact you on any service Abuse issues as well. If our antifraud mechanism screens your order for High risk, it will be necessary for you to provide a valid photo Identification and “Any” other needed verification documents. Any accounts failing verification would be treated as fraud and service would be denied to such clients/accounts. Clustered Hosting setups involve manual admin work to setup a load balanced hosting account for you. This process cannot be automated and so no immediate setups are available currently. We are working on automated setups for shared cluster orders but the API is still in beta testing phaze and so not available for production use. The setup time required for your account would be around 24-48 hours max from the moment your account is completely paid and verified. You will get a detailed email on how to use the clustered hosting once the setup is complete.

2.) 3rd party Software Service Terms:

We use softwares/scripts like Cpanel or other control panels etc which are sole copyrighted properties of their developers. Any possible change to their code/working would not be supported by us. These softwares/scripts are provided on an as/is basis and direct support for these won’t be available from our end.

3.) Payment Validity and Verification:

You agree to pay appropriate and full payment for our services. These would be paid in advance of the time period during which services are provided. Unless you notify us about your wish to cancel any or all services received, those services will be billed on a recurring basis. It is your responsibility to keep your payments upto date and paid in full. Your account will be suspended on the second suspension notice. A late fee of 5% of the monthly fee will be charged for overdue invoices.

4.) Site Content:

Our services must be used for lawful purposes only. Our “Customer” agrees that it shall defend, indemnify, save and hold RRDNS.com (Shared Hosting Division) harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against RRDNS.com (Shared Hosting Division), its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns
Customer agrees to defend, indemnify and hold harmless RRDNS.com (Shared Hosting Division) against liabilities arising out of:

  1. any injury to person or property caused by any products sold or otherwise distributed in connection with RRDNS.com (Shared Hosting Division).
  2. any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
  3. copyright infringement and
  4. any defective products sold to customers from RRDNS.com (Shared Hosting Division)’s commissioned services.

You may strictly not use any content which may infringe upon any copyrights or trademarks. This includes but is not limited to unauthorized copying of books, images, music or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. We will remove any account found to be in violation of anothers copyright, or access to the material disabled. An account which is found to be violating copyright laws repeatedly will be suspended and/or terminated from our clustered hosting. If you think that your copyright or trademark is being infringed upon, please email abuse@rrdnshosting.com with the information required.

Examples of unacceptable material on all Shared clustered servers include:

  • Topsites
  • IRC Scripts/Bots
  • Proxy Scripts/Anonymizers
  • Pirated Software/Warez
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • File Dump/Mirror Scripts (like rapidshare,mediashare etc)
  • Escrow/Bank Debentures
  • High-Yield Interest Programs (HYIP) or Related Sites
  • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
  • Sale of any controlled substance without prior proof of appropriate permit(s)
  • Prime Banks Programs
  • Lottery Sites
  • MUDs/RPGs/PBBGs
  • Hateful/Racist/Harassment oriented sites
  • Hacker focused sites/archives/programs
  • Sites promoting illegal activities
  • Forums and/or websites that distribute or link to warez/pirated/illegal content
  • Bank Debentures/Bank Debenture Trading Programs
  • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
  • Mailer Pro

Any content/site data which in our judgment, is obscene, harmful, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice. We reserve the right to refuse service to anyone.

You should respond to the abuse mails within 48 hours. Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services.

Any porn content related to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita):

Any site found to host child pornography or linking to child pornography will be terminated immediately without notice.

Violations will be reported to the appropriate law enforcement agency.

It would be your responsibility to keep your scripts/databases and data up to date with all current security patches applied. We would not be responsible for script security on your accounts and the client would need to take the responsibility of any hacks or illegal activities done from their accounts. You should agree to use complex secure passwords on our services for better security.We do not have any control on your data. You may store any critical and extremely important data on the server at your own risk. We suggest you to get a backup solution if you have any data which cannot be lost at any cost due to hardware failures etc. You can opt in for managed backups with our services or maintain your own backups.

6.) Zero Tolerance Spam Policy
We have a Zero Tolerance Spam Policy on our Shared Clustered Services. “Safe lists” and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice. We strictly do not allow unsolicited e-mail, bulk emailing, and spam. Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal.

7.)Backups or Data Loss
Your use of this service is at your sole risk. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data. Backups will not be provided for accounts that have been suspended or terminated for any reason. Our managed backup service is an addon and needs to purchased for each account.

8.) Cancellation and Refunds:
RRDNS.com reserves the right to cancel the services any time. For customers who are found to be breaking the TOS, their services will be suspended with appropriate warning and then terminated of found guilty twice.

Services are mostly leased on a month-to-month contract. You may cancel a server 7 days before your next billing data to avoid rebilling for the next month. Licensing services, SSL certicates, domain registrations and Clustered Hosting Solutions are not eligible for refunds in any month due to the nature of the service. We will however provide appropriate credit to your account if you face any problems with our networks or any other issue which are our faults.

9.) Pricing Changes:
Your service’s per month price will remain the same as long as the service is active with us. However, we reserve the right to change the pricing on http://www.RRDNSHosting.com (Shared Hosting Division) at any point of time.

10.) Indemnification(Repeat):
Our “Customer” agrees that it shall defend, indemnify, save and hold RRDNS.com (Shared Hosting Division) harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against RRDNS.com (Shared Hosting Division), its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.

11.) Disclaimer Statement:
RRDNS.com (Shared Hosting Division) will not be responsible for any damages your business may suffer. RRDNS.com (Shared Hosting Division) makes no warranties of any kind, expressed or implied for services we provide. RRDNS.com (Shared Hosting Division) disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by RRDNS.com (Shared Hosting Division) and its employees.

12.) Disclosure to law enforcement:
We may disclose any subscriber information to law enforcement agencies without any/further consent or notification to the subscriber upon lawful request from any such agencies.

13.) Changes in the Terms Of Service:
RRDNS.com (Shared Hosting Division) reserves the right to make changes its policies at any time without notice.
